We are concerned to hear about the Babylon Health data breach following the story hitting the headlines and our firm being approached for media comment.

The app has been used for GP video appointments and reportedly has more than 2.3 million registered users in the UK. We understand that it may be popular right now as a result of the coronavirus pandemic, and now – more than ever – we need to make use of technology to keep us all safe. That being said, information must be safe and secure, and must not be exposed. If it is, victims should know their rights.

If you have been affected by this incident, we may be able to help you.

About the Babylon Health data breach

It’s understood that the Babylon Health data breach has come to light following a user reporting that they could access the video recordings for other people. The user had accessed the app to follow up a prescription where he noticed that he could access around 50 videos in the Consultation Replay section of the app, according to the BBC.

The data breach reportedly stemmed from a software error that has been resolved, and the breach has been reported to regulators. The company has made assurances that only a small number of people were affected, and it’s understood that a recording may have been viewed.

What can victims of the data breach do?

If private information from video recordings has been leaked as a result of the Babylon Health data breach, victims could be entitled to make a claim for compensation.

So far, the statements made by the company suggest that this is a small and isolated breach in terms of the number of people affected. However, we know from a great deal of experience in this complex and niche area of law that more details may come to light, so we cannot rule out more people being affected.

Hopefully, this won’t be the case, but we know that it’s unwise to assume so.

If anyone has had their private and sensitive medical data exposed, they could be eligible to bring a claim for data breach compensation on a No Win, No Fee basis. Medical data claims account for a significant proportion of the individual cases that we take on because of how often they can happen and because of how severe the impact can be. We have represented victims and settled cases where recordings of healthcare appointments have been at the centre of the breach, so we are well equipped to help people.

Data breach compensation amounts can be significant for cases of this nature.
