We have been approached for help following the Accident Exchange – AX data breach – which is understood to have occurred earlier this year in January. The company is said to have suffered a cyberattack which led to the exposure of client information, with an external third-party accessing the company\u2019s systems.<\/p>\n

Those affected by the breach have recently been notified by AX (formerly Accident Exchange) that their personal information might have been affected, though it is still unclear exactly what details may have been exposed in all cases.<\/p>\n

We have already begun taking on claims for those affected, who could be in line to receive compensation for the exposure of their private data. All companies are legally obliged to protect the data in their possession and, when they fail to do so, they can be liable to pay damages for a breach of data protection law.<\/p>\n

The notification to customers – data at risk<\/strong><\/h3>\n

The incident is particularly concerning given the kind of sensitive information AX may hold about its customers. As a firm that offers temporary car hire to victims of road traffic accidents, AX may be in possession of highly private details relating to these accidents and the injuries they have caused.<\/p>\n

Despite the fact the incident is understood to have occurred in January, some clients may have only received notification of their involvement in the AX data breach more recently. The notification email from AX states that a number of the company\u2019s files are believed to have been accessed by an unauthorised third party.<\/p>\n

However, it seems AX may need to issue more details in terms of the exact details exposed by the breach. The company has so far stated that the issue has been resolved by experts, and that those affected are unlikely to fall victim to identity theft or fraud.<\/p>\n

Unfortunately, it is understood that the victims of the AX data breach could be targeted by scammers, due to the fact their contact details may have been exposed. Overall, the affected information is believed to include customer reference numbers, personal details, contact information, vehicle data, and details relating to their insurer and any accident they have been involved with.<\/p>\n

AX states that it has contacted the ICO and has also been in contact with the police following the data breach, but some victims are still in a state of uncertainty. If AX is found to have failed to protect customer data, they may be liable to pay compensation to those affected, so the victims could be entitled to make data breach claims<\/strong>.<\/a><\/p>\n
