Compensation for medical data leaked online

You could be entitled to claim compensation when medical data leaked online has caused you to suffer from distress. The GDPR can allow the victim of any kind of information exposure, or misuse, to receive compensation for the distress caused by the loss of control of their personal information.

It goes without saying that healthcare data is precisely the kind of information that people want to remain private and confidential. We do not want people to know about our private and sensitive medical statuses. We do not want people to know about certain treatment that we have had. We do not want everyone to know details about our mental health and our personal domestic situations, which are often reflected in our medical records.

This is why medical data breach compensation claims are often so severe in terms of the impact for the victim. The law is on your side, and we represent thousands of clients for cases, many of whom are claiming for some form of medical data breach.

Data breach compensation amounts can be substantial, and we will consider all necessary factors to make sure that the victim receives the justice that they deserve. This includes:

  • The nature of the data breached;
  • How much information is involved;
  • Who your details have been exposed to, or misused by;
  • The personal impact for you, which can differ from person to person.

The recent Wales Covid data breach incident

You may have heard in recent news about the Wales NHS Covid data breach, where medical data leaked online involved over 18,000 Welsh residents who had tested positive for Coronavirus. Their personal information was accidentally made public and, in a statement from Public Health Wales, they said that the incident arose from “human error”.

The incident occurred on the afternoon of 30 August 2020 and resulted in the personal information being searchable by anyone. It is understood to have been viewed on dozens of occasions and was online for 20 hours before the error was identified.
