Can you claim for data leaks to other users and customers?

You could be able to claim privacy compensation for data leaks to other users or customers where your information has been exposed to other people. A common way in which this can happen is when system errors and malfunctions result in other people seeing the data for other users when they log into their own accounts online. Another way is where the wrong information is sent to the wrong people, perhaps due to a human error or where mass letters or emails have been sent out but the mail merge has gone wrong.

If you have been affected by an incident of this nature, and your information has been misused or exposed, this could entitle you to recover compensation for any distress that you suffered from. The GDPR can entitle you to claim damages for distress which can be caused by the loss of control of your personal information.

Whether the issue stemmed from a simple error, or a technical malfunction, where we can prove that a breach of the GDPR has taken place and you suffered distress, that is where we can succeed with a case. You can speak to our team here now for free, no-obligation legal advice to find out if we can help you today.

The Royal Mail incident this year

There was a recent incident a few weeks ago involving the Royal Mail which involved data leaks to other users where information was visible to other people when they were accessing their website. Media reports confirmed that the issue affected its “click and drop” service and resulted in some customers being able to see the order details for other people.

The Royal Mail was forced to suspend its “click and drop” service whilst the matter was dealt with. They subsequently launched an investigation and apologised for any inconvenience that had taken place as a result of the incident.

Workplace leaks: breach of data protection act by an employer

If data leaks happen in a workplace setting, this can constitute a breach of the data protection act by your employer. Your employer has an important responsibility to protect the information in their care, so any breach of your right to privacy in a workplace setting can mean that they are negligent and liable to compensate you.

A great deal of personal and sensitive information is often stored and processed by employers. From the usual contact details to financial information for wages, to also sensitive medical and domestic information for employer support, there is a lot that could be affected by a breach.

In an example of one of the 60 group actions that we have launched for people, we represent employees of Manchester United who were subject to a breach where their personal information was leaked to other people.
