How We Value Your Data Breach Compensation Claim
We use a combination of our specialist experience and legal precedents so we know how much compensation you can claim for a breach of the Data Protection Act.
Although claiming compensation for data breaches is a relativity new area of law, it has grown rapidly in recent years. We've spent a long time focusing on fighting for the rights of victims claiming compensation for breaches of the Data Protection Act. That's why thousands have come to us for help, and why we're now fighting for justice in dozens of data breach actions; from the British Airways and Ticketmaster breaches from last year, and right back to the TalkTalk hacking and 56 Dean Street leak of 2015.
For us to know how much compensation you could claim for a breach of the Data Protection Act, we need to carefully assess a number of factors.
This includes:
- How much of your data has been exposed
- The nature and sensitivity of the data exposed
- Who the data has been exposed to
In cases where more data has been exposed, or where the data exposed is particularly sensitive (like medical data for example), a claim could be worth more. If the data has been exposed on the internet and there's simply no way of containing the breached data, that can also mean a claim could be worth more.
The 56 Dean Street action is a strong example in terms of the severity of the data that has been exposed. In this incident, the HIV statuses for hundreds of patients at the clinic was leaked in an email. This incident has understandably caused significant distress to the victims who are claiming data breach compensation with us.
What You Claim For
In a claim for data breach compensation, you can typically claim General Damages and Special Damages. Put these together and we can then know just how much compensation you could claim for a breach of the Data Protection Act.
General Damages can cover any distress caused to you and can encompass any psychological injury you may have suffered. Special Damages can account for any losses and expenses, such as lost earnings from time off work caused by the distress, or losses caused by fraudulent activity that's related to the breach.
It's important to recognise that there's a lot we need to consider before we can truly know how much compensation you could claim for a breach of the Data Protection Act.
We can also take into account your own personal circumstances, and how this may have a particular impact on your personal life and career as well. There can be a lot to assess, and we use a combination of our unique, specialist experience and legal precedents - plus expert evidence - to value your case.
